1. Agreement to these Terms

These Terms & Conditions (“Terms”) govern your access to and use of the VitCheck mobile application and the website at vitcheck.app (the “Services”), provided by Oblix Apps LLC (“we,” “us,” or “our”).

By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. Description of the Services

VitCheck helps you upload lab or blood test reports and receive educational insights about vitamins, minerals, and related nutritional topics, including food suggestions and progress tracking. Some features may require an active subscription.

3. Not medical advice

The Services are for educational and informational purposes only. VitCheck does not provide medical advice, diagnosis, prognosis, or treatment. Content generated by the Services is not a substitute for professional medical advice. Always seek the advice of a qualified healthcare provider with any questions about a medical condition, lab result, supplement, or treatment. Never disregard professional medical advice or delay seeking it because of something you read or saw in the Services.

If you think you may have a medical emergency, call your local emergency number immediately.

4. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement of a parent or legal guardian.

5. Accounts and acceptable use

You agree not to:

Use the Services for any unlawful purpose
Upload content you do not have the right to upload, or that infringes others’ rights
Attempt to reverse engineer, disrupt, or gain unauthorized access to the Services
Misrepresent insights from the Services as professional medical advice
Interfere with other users’ enjoyment of the Services

You are responsible for the accuracy of information and files you submit.

6. Subscriptions and billing (Apple)

VitCheck offers auto-renewable subscriptions through the Apple App Store. Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel subscriptions in your App Store account settings after purchase.

Any unused portion of a free trial period, if offered, is forfeited when you purchase a subscription where applicable. Pricing and plan details are shown in the App Store at the time of purchase.

7. Refunds

Purchases made through the App Store are subject to Apple’s refund policies. We do not control Apple’s refund decisions. To request a refund, use Apple’s report a problem / purchase support tools.

8. Intellectual property

The Services, including software, branding, text, graphics, and other content (excluding your uploaded content), are owned by Oblix Apps LLC or its licensors and are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes in accordance with these Terms.

You retain ownership of content you upload. You grant us a limited license to process that content solely to provide and improve the Services.

9. AI-generated insights

Insights may be generated using automated systems. Outputs can be incomplete, inaccurate, or inappropriate for your situation. You remain responsible for how you interpret and act on any insights. Always verify important health information with a healthcare professional and original lab documentation.

10. Disclaimer of warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT INSIGHTS WILL BE ACCURATE OR COMPLETE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OBLIX APPS LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR, IF GREATER, THE MINIMUM AMOUNT REQUIRED BY LAW).

12. Indemnification

You agree to defend, indemnify, and hold harmless Oblix Apps LLC and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your uploaded content, or your violation of these Terms.

13. Termination

We may suspend or terminate access to the Services if you violate these Terms or if we discontinue the Services. You may stop using the Services at any time and cancel subscriptions via Apple.

14. Changes to the Services or Terms

We may update the Services and these Terms from time to time. We will post updated Terms on this page with a revised date. Continued use after changes become effective constitutes acceptance.

15. Governing law

These Terms are governed by the laws applicable to Oblix Apps LLC, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country provide otherwise.
